RSC ID terms and conditions
These terms and conditions (“Terms”) govern the creation and usage of your RSC ID and thereby our Site (as defined below). Please read these Terms carefully before you start to use our Site, as these will apply to your use of our Site. We recommend that you print a copy of this for future reference. In order to set up and use your RSC ID you confirm that you have read and understood these Terms and that you agree to be bound by all of its provisions. If you do not accept these Terms in full, you must leave these pages immediately.

INFORMATION ABOUT US


The Royal Society of Chemistry operates websites including www.rsc.org and is a charity registered in England and Wales under charity number 207890, with our registered office at Burlington House, Piccadilly, London, W1J 0BA and our VAT number is GB 342 1764 71. The RSC, as a charity, is regulated by the Charity Commission and their website is available at www.charity-commission.gov.uk.

Throughout the Terms the following apply:

“RSC” means the Royal Society of Chemistry, RSC Worldwide Ltd and RSC Worldwide (US) Inc. and any other organisation owned/controlled by The Royal Society of Chemistry.

“Site” means all RSC owned websites and platforms.

YOUR RSC ID


Please note that if you are using the RSC ID on behalf of a company, University or other organisation (“Organisation”), you are nevertheless individually bound by these Terms even if your Organisation has created a separate RSC ID. If you do not wish to create an RSC ID, please do not click “GET STARTED” and leave these pages immediately.

OTHER APPLICABLE TERMS


These Terms refer to the following additional terms, which will also apply to your set-up and use of your RSC ID: With reference to other RSC products and services, please note that further terms and conditions may apply (“Additional Terms & Conditions”). Please note that these terms and conditions and policies may reference each other and are not mutually exclusive. If there is any conflict between the terms and conditions and policies, the conflict shall be resolved according to the following order of priority:
  1. Additional Terms & Conditions;
  2. Our terms and conditions of supply;
  3. These Terms;
  4. Terms & Conditions.
In addition, please read our Privacy & Cookies Policy (http://www.rsc.org/help-legal/legal/privacy/) which applies to our collection and use of your personal data/information in relation to our Site.

CHANGES TO THESE TERMS


We may revise these Terms at any time by amending this page or notifying you otherwise. Please check this page from time to time to take notice of any changes we made, as they are legally binding on you.
If you do not want to agree with the revisions to these Terms, you can deactivate/close your RSC ID at any time in accordance with clause 11.1 of these Terms. By continuing to use the RSC ID after notice of changes as published on our Site or otherwise communicated to you, you are consenting to the changes.

1 SETTING UP YOUR RSC ID


1.1 When creating your RSC ID, you will be asked to create a preferred display name (“PDN”) and password (“Sign-in Details”). Your Sign-in Details must be: (i) accurate and not anonymous (except for your password); (ii) kept strictly confidential; and (iii) not be transferable to anybody else.

1.2 When creating your RSC ID, you will be asked to provide personal data/information about you, which may consist of: your name, email address and date of birth.

1.3 By creating an online RSC ID, you confirm that you are at least 16 years old. If you are between the ages of 16 and 18, you confirm that you have obtained your parent’s or guardian’s permission before creating your online RSC ID. If you do not have this consent, you are not allowed to provide us with any of your personal data/information.

1.4 You confirm that the personal data/information you are required to provide when you create your RSC ID, is true, accurate, current and complete in all respects and you agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

1.5 By creating your RSC ID, you also confirm that: (i) you are not currently restricted from creating and/or using an RSC ID; (ii) you have full power and authority to create an RSC ID; (iii) you are not creating the RSC ID without authorisation from your Organisation (if applicable) and (iv) you are not creating an RSC ID for anyone other than a natural person; and (v) you agree to comply with all other provisions of these Terms together with all other RSC terms and conditions and policies referred to herein.

1.6 We reserve the right to remove your PDN and/or request that you create a new PDN in certain circumstances, for example, if we deem such PDN selected by you to be offensive or otherwise in contravention of these Terms.


2 YOUR RESPONSIBILITIES


2.1 By accepting these Terms, you agree to comply with all applicable laws, including, without limitation, privacy laws, intellectual property laws, tax laws and regulatory requirements.

2.2 If you set up your RSC ID, you are responsible for all RSC ID sessions and any transactions and/or activities taken via your RSC ID and you must keep your Sign-in Details confidential and not disclose them to anyone. You should change your Sign-in Details immediately if you feel they have been compromised.

2.3 You are responsible for maintaining confidentiality of your Sign-in Details, restricting access to your computer and/or preventing unauthorised access to your RSC ID or posting in a publicly accessible place, for example, on a web page. If you believe that your RSC Sign-in Details are being or are about to be used by anyone else you should inform us immediately at technicalsupport@rsc.org.

2.4 You acknowledge that you are prohibited from transferring your RSC ID to any other person and/or Organisation.

2.5 In the event that we deactivate or close your account, you agree that you will not create another RSC ID without our written permission.


3 RSC’S RESPONSIBILITIES


3.1 We confirm that we will protect your personal data/information in accordance with our Privacy & Cookies Policy and we will fully comply with all applicable UK Data Protection laws in place from to time. Except if in accordance with clause 9.2 of these Terms, we will not divulge any personal data/information that you provide to us. We use your personal data/information for the following purposes:

  1. To administer our Sites, provide services to you and to deal with your requests and enquiries;
  2. To serve Site content and advertisements to you;
  3. To provide you with information about our services, activities or online content;
  4. For statistical or survey purposes to improve our Site and our services to you;
  5. to contact you about content you have posted or uploaded.

3.2 RSC shall use reasonable efforts to ensure that the information contained on our Site is accurate and up-to-date, but RSC and any other party (whether or not involved in creating, producing, maintaining or delivering the Site) accepts no liability for omissions or errors therein or their consequences. RSC shall not be liable for any consequential, direct or indirect loss or damage of any nature whatsoever alleged to be caused by inaccuracies, errors or omissions in the information contained on our Site.

3.3 RSC makes no representations whatsoever about the suitability of the information contained on our Site. The content on our Site is provided “as is”, without conditions, warranties or other terms of any kind.


4 INTELLECTUAL PROPERTY RIGHTS


4.1 Unless stated otherwise, the copyright and other intellectual property rights in all materials on our Site (including without limitation photographs and graphical images) are owned by the RSC or its licensors.

4.2 You will find further information relating to intellectual property rights in our Terms & Conditions, located here http://www.rsc.org/help-legal/legal/terms-conditions/. For the avoidance of doubt, you are also bound by these Terms of Use.


5 RSC PRODUCTS/SERVICES, PROMOTIONS, SPECIAL OFFERS ETC.


5.1 When you create an RSC ID you will be given the option to receive information from the RSC by e-mail about our related activities, products/services, promotions or special offers which we feel may be of interest to you. If you do not wish to be contacted for such purposes, ensure that you select the appropriate option as applicable. You may unsubscribe from our contact list at any time by clicking on the ‘unsubscribe’ link in the RSC email you have received from us.


6 ACCESSING OUR SITE & AVAILABILITY


6.1 We reserve the right to modify, suspend or discontinue all or part of the RSC ID or any part of the RSC ID without giving any notice to you.

6.2 Whilst the RSC ID service is available free of charge to you, other RSC goods and services may be subject to a charge which will be indicated to you prior to or at the point of purchase.

6.3 Although the RSC endeavours to ensure that our Site is normally available and uninterrupted 24 hours a day, the RSC shall not be liable if for any reason our Site and/or any website which you have reached via a link on our Site is unavailable, suspended or interrupted at any time or for any period.

6.4 Access to our Site may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the RSC’s control.

6.5 You are responsible for making all arrangements necessary for you to have access to our Site.


7 NOTIFICATIONS AND SERVICE MESSAGES


7.1 For the purposes of notifying you about changes and/or updates in the RSC ID, we may email you at the email address associated with your RSC ID.

7.2 You also agree that we may communicate with you through your RSC ID or through other means including email and any other contact details you have provided us about your RSC ID or services associated with it. You acknowledge and agree that, subject to clause 10.6, we shall have no liability associated with or arising from your failure to maintain accurate contact or other information, including, but not limited to, your failure to receive critical information about the RSC ID.


8 SUSPENDING/DISABLING YOUR ACCOUNT


8.1 RSC reserves the right to suspend and/or disable any RSC ID or /Sign-in Details, whether chosen by you or allocated by us, at any time without notice to you, if in our reasonable opinion you have failed to comply with any of the provisions of these Terms or you otherwise create risk or possible legal exposure for the RSC. For the avoidance of doubt, these Terms include all those terms and conditions/policies listed under the section ‘OTHER APPLICABLE TERMS’ on pages 1 and 2 above.


9 SECURITY & DISCLOSURE OF YOUR INFORMATION


9.1 Personal data/information you provide will be secured in accordance with our obligations under the Data Protection Act 1998. On the basis that the internet is not a 100% secure environment, we cannot ensure or warrant the security of any personal data/information you transmit to RSC. There is no guarantee that personal data/information may not be accessed, copied, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

9.2 Where we are required to disclose your personal data/information if required by law (for example under section 29 of the Data Protection Act 1998), you acknowledge that we may use your personal data/information to inform relevant third parties such as your employer or internet provider about the content and your behaviour.


10 LIMITATION OF LIABILITY


10.1 To the extent permitted by law, we exclude all conditions, warranties, representations or other terms which may apply to our Site or any content on it, whether express or implied.

10.2 In no event will the RSC be liable for any loss or damage, including but not limited to general, special, direct, indirect, consequential or incidental damages, or any damages whatsoever, resulting from loss of use, data or profits, whether in an action of contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • use of, or inability to use, our Site; or
  • use of or reliance on any content displayed on our Site.

10.3 If you are a business user, please note that in particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.

10.4 In no event shall RSC be liable for any loss or damage to your computer equipment or software which may occur on account of your access to or use of our Site or on any website linked to our Site, or your downloading of materials, data, text, or images from our Site, whether caused by a virus, bug, distributed denial-of-service attack or otherwise.

10.5 This Site is linked to third party sites and applications. The linked sites are outside the control of RSC and RSC is not responsible for the contents of any linked site or any link contained in a linked site. RSC provides these links only as a convenience, and the inclusion of any link does not imply endorsement or approval by RSC of the site. RSC is not responsible for the contents of any site linking to this Site nor for any loss or damage that may arise from your use of them.

10.6 Nothing in these Terms excludes or limits our liability for death or personal injury arising from our negligence, or our fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

10.7 Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any goods/services by us to you, which will be set out in our terms and conditions of supply (https://www.rsc.org/basket/ShoppingCart/termsandconditions).

10.8 The RSC is not responsible for any loss or damage if the RSC ID is not provided to you or is interrupted or suspended or if the RSC does not comply with these Terms because of events beyond the RSC’s control, including but not limited to an act of God, accident, fire, lockout, strike or other official or unofficial labour dispute, civil commotion, rule or order or act of Government or other event beyond the reasonable control of the RSC.


11 DEACTIVATING OR CLOSING YOUR RSC ID ACCOUNT


11.1 You may deactivate or request that your RSC ID be closed at any time, for any or no reason, upon notice to us in accordance with clause 12.3 of these Terms. This notice will be effective upon the RSC processing your notice.

11.2 RSC may deactivate or close your RSC ID for any reason or no reason, at any time, with or without notice. This deactivation or closure shall be effective immediately or as may be specified in the notice.

11.3 If you close your RSC ID, subject to clause 11.5, you will be permanently deleting your account, so you should only close your account if you are sure that you will not want to reactivate your RSC ID in future.

11.4 Upon deactivation or closure of your account, you lose access to all those products and services you access via your RSC ID. Any and all applicable provisions of these Terms shall survive any deactivation or closure of your RSC ID.

11.5 If we or you close your RSC ID, we have no obligation to retain your information, and may delete any or all of your account information without liability. However, we may retain certain data contributed by you if we believe it may be necessary to prevent fraud or future abuse, or for legitimate purposes, such as analysis of aggregated, non-personally identifiable data, account recovery, or if required by law. We may also retain and use your information if necessary to provide the services to other users, for example, information you have uploaded, posted or shared with others using your RSC ID may remain visible. Please note that we accept no responsibility and have no control over third party sites and applications or any data captured by them, for example where such third parties may save information or data locally to their site or application. Furthermore, please note that the RSC does not control when search engines update their cache, which may contain information that has since been removed from our Site.

11.6 If we learn that a user is deceased, we may memoralise the user’s RSC ID. In these cases we may restrict access to Site content and close an RSC ID if we receive a formal request from the user’s next of kin or other proper legal request to do so.

12.2 In addition to clause 7 Notices and Service Messages’, we may notify you via postings on www.rsc.org.

12.3 All notices given by you to us must be given to Royal Society of Chemistry at: Publishing Services, Customer Service, Thomas Graham House, Science Park, Milton Road, Cambridge, CB4 0WF, email technicalsupport@rsc.org (for all non-legal notices) or legalservices@rsc.org (for legal notices only).

12.4 Notice will be deemed received and properly served 24 hours after an email is sent, or three (3) days after the date of posting of any letter.


13 ASSIGNMENT & DELEGATION


13.1 You may not assign or delegate any rights or obligations under these Terms and consequently any purported assignment and delegation shall be ineffective. We may assign or delegate all rights and obligations under these Terms, fully or partially without notice to you. We may also substitute, by way of unilateral novation, effective upon notice to you, the RSC for any third party that assumes our rights and obligations under these Terms.


14 APPLICABLE LAW


14.1 These Terms, its subject matter and its formation, (and any non-contractual disputes or claims) are governed by English law. Any dispute arising from, or related to these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

14.2 If you are located outside of England and Wales, you may have rights or obligations under local law(s) other than those set out in these Terms.
